These Terms of Service (“Terms”) govern your use of the Balkan Clan websites balkanclan.com and orion.balkanclan.com (the “Service”). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old to create an account or upload content. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. Our Service is not directed to children under 13.
You are responsible for your account, including keeping your login credentials confidential and for all activity under your account. We may change, suspend, or terminate your account at any time if you violate these Terms or our community standards, or if we reasonably believe your account creates risk to users, our Service, or third parties.
You agree not to upload, post, or share content that is illegal, infringing, harassing, hateful, pornographic, violent, or otherwise harmful, and not to:

You retain ownership of content you upload (e.g., videos, thumbnails, comments, profile data). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transcode, adapt (e.g., generate thumbnails, previews), display, perform, and distribute your content on and in connection with the Service for the purposes of operating, promoting, and improving the Service. This license ends when you remove your content or delete your account, except where we must retain copies for legal, security, or backup reasons (see Privacy Policy).
You represent and warrant you have all rights necessary to grant this license and that your content complies with these Terms and applicable law.
To operate the Service, we collect and display video-related metrics such as views, likes/dislikes, watch counts, comment counts, and (if enabled) watch time. Some statistics may be shown publicly on your videos and profile. We also generate aggregated, per-day analytics and charts for your account, which you can export (e.g., CSV/PDF/PNG). Exported analytics contain aggregated metrics and do not include private messages. Details on the data we collect and how we process it are in our Privacy Policy.
Optional features may connect to third-party services (e.g., Steam API if you choose to share your Steam ID; links to your social profiles). Your use of those services is governed by their terms and policies.

The Service (including design, logos, software, and content other than your own) is our property or licensed to us and protected by law. Except for your content and as permitted by law, you may not copy, modify, distribute, sell, reverse engineer, or lease any part of the Service.

We may suspend or terminate your access (with or without notice) if you violate these Terms or we believe your use risks harm, legal liability, or service disruption. Upon termination, your right to use the Service ceases immediately. Certain provisions survive termination (e.g., IP, disclaimers, limitations of liability).
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee the Service will be error-free, secure, or uninterrupted.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the greater of €100 or the amount you paid us in the 12 months before the claim arose. Nothing in these Terms limits mandatory consumer rights that cannot be waived by contract.
Your use of the Service is governed by our Privacy Policy, which explains what personal data we collect, how we use it, and your rights.
We use essential cookies for security, session continuity, and core functionality; you cannot opt out of essential cookies without breaking the Service. Optional analytics cookies (e.g., Google Analytics) are used only with your consent and can be changed at any time via the cookie banner.

We retain data as long as you have an account or as needed to provide the Service. Session data is automatically cleared after 1 hour of inactivity, and sessions are destroyed after 75 minutes. Video analytics and engagement metrics are stored to provide long-term statistics and insights. If you request deletion of your account, associated personal data (including analytics) is deleted or anonymized, subject to legal obligations and reasonable backup cycles. These Terms are governed by the laws of Belgium, without regard to conflict-of-law rules. You agree to first try to resolve any dispute informally by contacting us at gdpr@balkanclan.com or support@balkanclan.com. If we cannot resolve it, the courts of Belgium shall have exclusive jurisdiction, unless mandatory consumer laws in your country provide otherwise.
If any provision of these Terms is held invalid, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of our right to do so later.
We may update these Terms to reflect changes to the Service or legal requirements. If we make material changes, we will post them here and, where appropriate, notify you in advance. Continued use of the Service after changes take effect means you accept the updated Terms.
